Terms of Use Thank you for choosing Liberty Coffee Pte. Ltd (“Liberty Coffee”, “we”, “our”) and using our service, website, and software applications (collectively, the “Services”).

By using, accessing, or signing up for any content or material made available by our Services (collectively, “Content”), you (“ the customer”) acknowledge that you have read, understood, accepted and agreed to be bound by our Terms of Use (“Terms”) and Privacy Policy (collectively “Agreements”). Please read them carefully.

Any changes, updates or revisions of Terms would be held effective immediately from the time we post them. Your continued use of our Services means you are agreeing to our Terms. Separate terms and conditions may apply on agreements including but not limited to venue rental, classes, events, wholesale agreements, equipment purchases, and will be stated on the contracts governing these agreements.

Privacy Policy
Your privacy is very important to us. Please review our Privacy Policy to understand how we handle your personal and/or corporate data and protect your privacy when you use our Services.

Use of Website
You represent and warrant that you are at least 18 years old or visiting the website under the supervision of a parent or guardian.

We reserve full rights to decline service, terminate your account, or cancel your orders in our sole discretion, including, without limitation, if we believe that your conduct violates applicable law or is harmful to our interests.

Our Content is solely for your personal, non-commercial use. You may view and print a copy of the Content displayed on the website, and distribute any Content that is designated for sharing on social media platforms, for your personal use only but you may not alter the Contents in any way, including, without limitation, removing or modifying any copyright or other ownership notices. The rights, title and interest in the Contents are not automatically transferred to you by copying or distributing the material.

Your Liberty Coffee Account
To use or access some of our Services, you may require a Liberty Coffee Account (“account”). In particular, an account is required in the Shop and Wholesale pages to facilitate online purchases, and other purposes. You may create a personal account, or your account may be assigned to you by your company or institution.

For personal and/or corporate data protection, the account password must remain confidential. You have complete responsibility for your account and the activity which occurs on the account. You shall immediately notify Liberty Coffee of any unauthorized use of your password or identification or any other breach or threatened breach of this website's security.

Acceptance of Orders
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of Liberty Coffee’s offer to sell. Currently, Liberty Coffee offers free domestic shipping only, and customers are responsible for adding valid Singapore Shipping addresses to qualify. Customers are also required to enter valid Billing Address details, and have to email buy@libertycoffee.sg in order to arrange for international shipping.

We reserve the right at any time after receipt of your order to accept or decline your order for any reason. Liberty Coffee reserves the right at any time after receipt of your order, to supply less than the quantity you ordered of any product without notice should stocks be insufficient. A refund will be issued for the unfulfilled portion of the order. We may require further verification and details before accepting an order.

Product Availability
The Website features Products that have been carefully selected for sale on the Website. Products are subject to availability so once a Product has sold out it will be taken off the Website at the earliest opportunity and may not be available again. As there is a delay between the time when your Order is placed, and the time when the Order is accepted, the stock position relating to a particular Product may change. If a Product you have ordered becomes out of stock before we accept your Order, then Liberty Coffee Pte Ltd shall not be liable to you for being unable to provide that Product. If such a situation arises, then we shall notify you as soon as possible and you will not be charged for the out of stock Product.

Our Codes, Vouchers and Other Prepaid Offers
Should you be in receipt of or have purchased a code, voucher, or other prepaid offer provided by Liberty Coffee for access to a paid subscription (“Code”), you understand and agree that there are separate terms and conditions accompanying the Code that may also apply to your access and usage of our Services.

Changes of Content
Liberty Coffee uses a commercially reasonable level of skill and care to provide accurate and up-to-date information on our website and software applications. However, we do not guarantee that all content in our Services is accurate, complete, reliable, current or error-free, and do not assume responsibility for any omissions or errors.

Product and Pricing
We are constantly changing, updating and revising our product offerings, and we may discontinue any product without notice at any time. All pricing for our product and service offerings is subject to change, and we reserve full rights to make adjustments due to changing market conditions, product discontinuation, manufacturer price changes, typographical errors, and other extenuating circumstances. Liberty Coffee shall have the right to refuse or cancel any orders placed for the product listed at the incorrect price, regardless of confirmation status of order and whether your credit card has been charged. If your credit card has already been charged for the purchase and your order is canceled, we shall immediately issue a credit to your credit card account in the amount of the charge. Additional terms and conditions may apply as stated in quotations provided.

Shipping Details
Currently, all orders are delivered through Singapore Post (SingPost) and are subject to the terms of their service. We are unable to guarantee against delays in delivery due to postal service issues.

According to SingPost, “a delivery advice will be slipped underneath the door of the addressee's address in cases of unsuccessful delivery...You can collect the item from the designated post office, or redirect it to another post office of your convenience or reschedule for another delivery”. Please check for such a delivery advice should your parcel not arrive. We currently offer free domestic shipping of coffee via SingPost’s PolyM mailer service, which is not tracked nor traceable.

Currently, website purchases are available for Singapore shipping addresses. However, international buyers can place their Liberty Coffee orders via email at buy@libertycoffee.sg.

Returns and Refund
We only accept returns and offer refunds on items which are proved to have been delivered in unsatisfactory condition. Liberty Coffee Pte Ltd will not be responsible for damage caused by third party delivery services. Customers are not entitled to a remedy if they damaged the item, misused it and caused the fault, tried to repair the item themselves or brought it to someone else to repair.

As a perishable item, coffee cannot be returned once purchased. Commercial equipment will also be subject to the terms and conditions of the sales agreement under which it is purchased.

We reserve the right to either repair or replace defective items. In cases where this is not possible, you will be refunded the original purchase price of the item minus a restocking fee (Restocking fee: S$5 for items costing less than S$20, and for items costing more than S$20, 20% of the item’s purchase price). Customers will be held responsible for cost of shipping goods back to Liberty Coffee Pte Ltd and for picking up replacement/repaired items (if applicable). Return shipping is the responsibility of the customer. Feel free to choose the shipping-carrier that’s most convenient for you (UPS, USPS, FedEx, Carrier Pigeon, DHL, etc.). We recommend insuring your shipment to protect against loss or damage.

To initiate a return, send your invoice number, date of purchase, item description, proof of damage at time of delivery and reason for return to Liberty Coffee at buy@libertycoffee.sg to request a return authorization code.

All items should be returned within 14 days of delivery. Return items must be in their original manufacturer’s packaging (unmarked) with all parts and accessories which were included in the original package. Consumables (such as filters, cloths) should be unopened and unused. Indicate your return authorization number on the outside of the shipping box. Please DO NOT make any markings on the product packaging, as products must be returned in original manufacturer’s packaging (unmarked) in order to qualify for a refund. Intellectual Property Rights
All content, including images, illustrations, designs, icons, photographs, video clips, text, software, graphics, logos, and other materials that are part of our Services are owned exclusively by Liberty Coffee, its affiliates and/or its content providers. The content is protected by copyrights, trademarks, service marks, trade dress and other intellectual or ownership rights owned by Liberty Coffee. Any rights not expressly granted in the Terms and Conditions are reserved for Liberty Coffee.

Disclaimer of Warranties
Liberty Coffee endeavours to provide the best Services we can, but you understand and agree that we cannot and warrant certain things about our Services.

YOU UNDERSTAND AND AGREE THAT LIBERTY COFFEE SERVICES IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT EXPRESS OR IMPLIED WARRANTY OR CONDITION OF ANY KIND. YOU USE LIBERTY COFFEE SERVICES AT YOUR PERSONAL RISK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER LIBERTY COFFEE NOR ANY PERSON ASSOCIATED WITH LIBERTY COFFEE MAKE ANY REPRESENTATIONS OR WARRANTIES OR CONDITIONS WITH RESPECT TO AVAILABILITY, ACCURACY, COMPLETENESS, SATISFACTORY QUALITY, SECURITY, OR RELIABILITY OF OUR SERVICES. NEITHER LIBERTY COFFEE NOR OWNER OF CONTENT WARRANTS THAT . IN ADDITION, LIBERTY COFFEE MAKES NO REPRESENTATION, WARRANTY, ENDORSEMENT, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY THIRD PARTY APPLICATIONS (OR THE CONTENT THEREOF), YOUR USE OF THIS SITE, YOUR USE OF EQUIPMENT OR SOFTWARE IN CONNECTION WITH OUR SERVICES, AND THAT OUR SERVICES ARE FREE OF ANY MALWARE OR OTHER HARMFUL COMPONENTS.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE EXCLUDE ALL WARRANTIES.

Limitations of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL LIBERTY COFFEE, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, LICENSORS, SERVICE PROVIDERS, OFFICERS OR SUPPLIERS BE LIABLE FOR DAMAGES OF ANY KIND INCLUDING BUT NOT LIMITED TO FINANCIAL LOSSES, PERSONAL INJURY, EMOTIONAL DISTRESS, LOSS OF DATA, LOSS OF USE, LOSS OF GOODWILL, LOSS OF USE, LOSS OF BUSINESS OR LOSS OF ANTICIPATED SAVINGS.

Indemnification
You agree to defend, hold harmless and indemnify Liberty Coffee and its affiliates, agents, directors, employees, licensors, service providers, officers or supplier from any claim, suit or action arising from or related to the use of our Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorney's’ fees.

Governing Law and Jurisdiction
The Agreements shall be governed by and construed accordance with Singapore law and we hereby submit to the non-exclusive jurisdiction of the Singapore courts.
